The Kestrel Market Sense name, logo, tagline ("Surfacing Cross-Market Signals™"), site design, scoring algorithms, and all related intellectual property are owned by nventiv LLC and protected by applicable intellectual property laws. You may not use our trademarks without prior written permission.

Market data displayed on the site remains the property of its respective data providers. Your use of such data is subject to the terms of those providers.

6. Third-Party Services

Kestrel Market Sense integrates with third-party services including Yahoo Finance, Kalshi, Cloudflare, and GitHub. Your use of data sourced from these services is subject to their respective terms and privacy policies. We are not responsible for the practices, accuracy, or availability of third-party services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TN APP STUDIO AND NVENTIV LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO INVESTMENT LOSSES, TRADING LOSSES, OR FINANCIAL DAMAGES OF ANY KIND.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED $100.

8. Indemnification

You agree to indemnify and hold harmless TN App Studio and nventiv LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or any financial decisions you make based on information viewed on the Service.

10. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Davidson County, Tennessee.

11. Dispute Resolution

Before filing a formal legal claim, you agree to contact us at legal@tnappstudio.com to attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal legal action.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted on this page with an updated effective date. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
